the future, in the name of multiculturalism ~

Federal judge orders female genital mutilation charges dropped in Detroit ~
DETROIT (WJBK) – A federal judge has dismissed six charges of female genital mutilation against a doctor, declaring the nation’s female genital mutilation law as unconstitutional.
The federal judge in Detroit ruled in the historic case on Tuesday, ruling the law that prevents female genital mutilation (FGM) is unconstitutional. U.S. District Judge Bernard Friedman ruled that congress does not have the authority to make FGM illegal, which it had been classified as illegal under the Necessary and Proper Clause or the Commerce Clause.
Jumana Nagarwala was arrested in April 2017. It appears she was the first person charged under a federal law, passed in 1996, which made the practice a felony. But now Judge Friedman has decided that it’s perfectly OK to perform this unsafe, unnecessary and frankly, misogynistic, procedure ~
FGM removes some or all of external female genitalia. There is no medical benefit to the procedure, which causes severe pain and serious health problems. It usually occurs in Africa, Asia and the Middle East. The World Health Organization calls FGM “a violation of the human rights of girls and women.” The organization notes that over 200 million women and girls currently living have undergone the procedure.
Friedman cited the Constitution’s Commerce Clause in his ruling, saying the “power to outlaw female genital mutilation … belonged to individual states.” Michigan actually has such a law in place – and it’s more harsh than the federal one (a 15 year prison sentence vs. 5 years under federal law). Unfortunately, it was passed after Nagarwala was arrested.
US District Judge Bernard Friedman concluded that “as despicable as this practice may be,” Congress does not have the authority to make it a federal law and criminalize the practice.

Female Genital Mutilation is currently banned worldwide and has been outlawed in more than 30 countries.
Apparently, Judge Friedman thinks the United States should stand with the barbaric nations who still allow this hideous practice.

The judge’s announcement came the same day as International Children’s Day, and the U.S. legal system failed to protect American girls against a dehumanizing cultural practice that reduces a girl’s value to little more than a breeder. For the last year since this trial came to surface, activists have struggled to pass laws against FGM because what is clearly gender violence is camouflaged as a community practice and protected as such.

Two utterly shocking stories are simply not making the top headlines anywhere in the West. In Somalia, a girl died after undergoing FGM aged 10. In Sudan, a wife miscarried aged 11, after her husband, in his forties, beat her.
